Terms &conditions.

Effective October 15, 2026Last updated October 15, 2026

The short version

  • Your signed service agreement sets the details of any package, and it wins if anything here conflicts.
  • Publishing Store purchases are non-refundable once work has started.
  • Payments run through Stripe, and payment plans through Partial.ly.
  • You keep 100% of your copyright, and we keep ghostwriting confidential.
  • We give every book our best, but we can't guarantee sales, rankings or placements.

Acceptance of these terms

These Terms and Conditions ("Terms") apply to your use of www.the1andonlypublishing.com and to services bought from Building Wealth Four Generations Inc., doing business as The 1 and Only Publishing ("The 1 and Only Publishing," "we," "us" or "our"). By using our website, booking a consultation, submitting a manuscript or buying a service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website or services.

Our services

We are a hybrid publishing company. Our services include ghostwriting, manuscript development, editing, cover and interior design, formatting, ISBN assignment, publishing and distribution setup, audiobook coordination, launch and marketing support, the Little Olive Books children's imprint, The Legacy Project, and individual services sold through our Publishing Store. Some services, such as Authority Build and visibility packages, are provided by our sister company, The 1 and Only Agency.

Service descriptions on our website are summaries. The exact scope, deliverables, timeline and price for a package are set out in your written service agreement.

Service agreements

Publishing, ghostwriting, Little Olive Books, Legacy Project and other packages require a signed service agreement. If anything in these Terms conflicts with your signed agreement, your signed agreement controls.

Free consultations, manuscript reviews and quotes are not offers to provide services. A quote becomes binding only when it is included in a signed agreement or paid for through our checkout.

Payments and payment plans

  • Payments are processed securely by Stripe. Payment plans may be offered through Partial.ly or as described in your service agreement, and are also subject to that provider's terms.
  • Prices on our website may change at any time. The price shown when you complete your purchase, or the price in your signed agreement, is the price that applies.
  • If a payment on a payment plan fails or is late, we may pause work until your account is current, as described in your service agreement.
  • Applicable processing fees, taxes and third-party costs, such as printing, shipping and government filing fees, are your responsibility unless your agreement says otherwise.

Refunds and cancellations

Publishing Store purchases are non-refundable once work has started. If you need to cancel a store purchase before we have begun work, contact us right away at [email protected] and we will review your request.

Refunds and cancellations for packages are governed by your signed service agreement.

Because our services are custom work, we do not offer refunds based on a change of mind, results such as sales or rankings, or delays caused by late materials or feedback.

In plain wordsOnce we start working on something you bought, it can't be refunded. For packages, your signed agreement explains your options.

Your book and your rights

You keep 100% of the copyright to your work. Unless your agreement says otherwise, you own the final manuscript, and you own or have rights to use the final cover and interior designs we create for your book once paid in full.

You give us a limited permission to use the materials you send us only to provide your services, including sharing them with our team members and publishing partners. Once your book is published, we may show its title and cover in our portfolio and marketing unless you ask us not to.

If we ghostwrite your book, the work is published in your name and we keep the ghostwriting relationship confidential.

In plain wordsYour book is yours. We only use your materials to do the work, and we never tell anyone we ghostwrote your book.

Your responsibilities

When you work with us, you agree to:

  • Send only materials you own or have permission to use, including text, photos, illustrations and recordings.
  • Not ask us to publish content that is unlawful, defamatory, infringing, hateful or that invades someone's privacy.
  • Have permission from anyone featured in your book or Legacy Project recording to share their story and likeness, where required.
  • Provide accurate information and give feedback and approvals in a timely way. Delays in materials or feedback may extend your timeline.
  • Review and approve proofs carefully. Once you approve a final file, later corrections may be billed as new work.

We may decline or stop work on content that we believe violates these Terms or our values.

No guaranteed results

We work hard for every author, but we cannot guarantee book sales, royalties, reviews, bestseller status, rankings, media coverage, speaking engagements, bookstore or school placements, or any other business result. Testimonials and examples on our website reflect individual experiences and are not a promise that you will get the same results.

Final placement decisions are made by retailers, bookstores, schools, libraries and other third parties, not by us.

Using our website

You may use our website for lawful, personal and business purposes related to our services. You agree not to:

  • Copy, scrape or reuse our website content, designs or code without permission.
  • Interfere with the website's security or operation, or try to access areas you are not authorized to use.
  • Submit false information, spam or harmful code through our forms.
  • Use the website in any way that violates the law or the rights of others.

Our website and services rely on third parties, including HighLevel (website, forms, scheduling and messaging), Stripe and Partial.ly (payments), Amazon KDP, IngramSpark and Draft2Digital (publishing and distribution), YouTube (video) and Google Maps (maps). Your use of these services may be subject to their own terms. We are not responsible for third-party services, their availability, or changes they make to their platforms, fees or policies.

Our affiliate program, The 1 and Only Agency's services and partner programs may have their own terms, which apply in addition to these Terms.

By giving us your email address or mobile number and agreeing to be contacted, you agree to receive messages from us about your inquiry, appointments, projects and payments, and, if you opt in, marketing messages. You may not use them without our written permission. Nothing in these Terms gives you ownership of our templates, processes, curriculum, workbooks or tools.

Disclaimer of warranties

Our website and its content are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the website will always be available, error-free or free of harmful components.

Limitation of liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales or data, arising from your use of our website or services.

Our total liability for any claim related to our website or services will not exceed the amount you paid us for the specific service giving rise to the claim in the twelve (12) months before the claim arose.

Indemnification

You agree to defend, indemnify and hold harmless The 1 and Only Publishing, Building Wealth Four Generations Inc., and their owners, employees and contractors from any claims, losses or expenses, including reasonable attorneys' fees, arising from the materials you provide, your content, your violation of these Terms, or your violation of anyone else's rights.

Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Prince George's County, Maryland, and you agree to the jurisdiction of those courts. Before filing any claim, we both agree to try to resolve the dispute informally by contacting each other in writing.

Changes to these terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Changes apply from the effective date and do not change signed agreements already in place. Continuing to use our website or services after an update means you accept the revised Terms.

If any part of these Terms is found unenforceable, the rest remains in effect.
